Expecting a Miracle

Well, we've decided my brother's PD is not going to be good enough, not only is he not giving Adam the things he's entitled to (like the statements from all the people involved) but he's also not pushing for Randy and Adam to have a separate trial.

Well, Adam has since turned to God and he believes that this was the purpose of his being arrested. He also believes that a wrongly accused minister in jail was put there by God to help him, because this minister definitely has helped Adam with his faith, reading the bible, talking with God, prayer, etc--the minister also thinks that Adam might have been God's reason for allowing him to go to jail for something he didn't do.

At any rate, this minister has referred Adam to a criminal lawyer he knows and my mother called him. Everywhere we've gone it's been in the $10,000 range but everyone has been really interested in taking this case after they've heard the details (they'd have to be crazy to turn down such easy money--this is a case only a disinterested PD could lose, and only if the jury was just as disinterested finding out, or determining for themselves what the PD didn't say but should have).

This lawyer's up front costs are $5000 plus $250 for each court appearance. Then he talked to my mom about the case. He was really curious how they are able to hold Adam at all on this. He said that they couldn't use the accountability law on charges like this and after he found out that Adam's already talked and all the witnesses point to Randy (in other words they are certain which one did the killing), my mom said he sounded like he was thirstily curious as to how they could possibly hold Adam on anything. He told my mom if she could find the money, he thinks the case will never go to trial. He says, based on everything he's been told, he's almost certain he could get them to drop the charges altogether, and if not, at the very least he knows he'll be able to get them lowered because there's just no way they can do that to Adam. In fact, he says, if my mom can scrape together $2500 he'll accept that for starting the case and then they can work out how to pay the other $2500 plus she'll need the $250 for each court appearance still. He also says if he doesn't win the case, all money will be refunded.

BUT, where are we going to get $2500 to start, let alone the $2500 once it's finished, the $250 for each court appearance is also going to be a little difficult to scrape together for us. This isn't exactly something you can run a fundraiser for or a benefit dinner (unfortunately, because I feel, given the circumstances, it is something worthy of such things).

At any rate, my only rich relative declined monetary aid, which is entirely her choice and understandable since it is a lot of money. Hopefully she stops the "poor me, my darling nephew is in jail for crimes he didn't commit and it's all my fault 'cause I didn't let him move in with me when he asked" <--like that would have helped anyway. Anyhow, I understand and am not mad about her lack of contribution, but I hope she doesn't continue her fake guilt trip woe is me act to go with it. If you're so concerned, help, if you're not, quit going on about it and how it effects you just so you can get attention and sympathy.

Despite all the other people there, Adam and the murderer are the only two in jail and 2 of the 5 witnesses have Adam hitting or pushing the victim, the other 3 have him uninvolved. Yes, bad things happen when you hang out with the wrong crowd, but don't you think 20 years to life (with no possibility of parole) is a high price to pay for a teenager who made the same mistakes most other teens make on a daily basis? Would you want your teen to be the next to witness an unexpected murder and get 20 years to life just for being there (and to top it all off they are the only witness of 5 others to be arrested and charged with the same 4 counts of 1st degree murder as the actual murderer)?

I'm sorry, I doubt I'll get any donations, but my mom says that God wouldn't have lead us to this point, to that minister, to this lawyer, had the upfront costs dropped by half, just to close the door, so, anything is possible. At least send my brother your regards and sympathies to my email address above and I'll make sure to mail them to him, he needs some letters of good intent to counter balance all the hate mail telling him to rot in prison.

Honest, he's done illegal things in the past, but never anything violent, but he was trying to turn his life around when he got arrested. He just got a job he was excited about 3 days before his arrest (and now he's lost it), and he just got approved for financial aid to go to the local community college. Now, more than ever, he feels the need to get his life straight, right down to who he hangs out with if he ever gets out of jail.

As for loans, we're willing to take out a loan for it, but none of us really have the credit to do so :/ Anyone giving out loans that they don't require mafia-like bloodshed or credit checks for?

Upon request, I can give you newer information that is more certain (less guess-work and assumptions) and more detailed.

At any rate, we all have a really bad feeling about his PD now, and there have been many PD cases lost here in Danville that should have been as easy to win as my brother's case. So, regardless of an easy win, PD's tend to screw things up around here.
